- Garden Maintenance: Regular upkeep of gardens, including mowing, weeding, and pruning.
- Landscape Design: Professional design services to create aesthetically pleasing and functional outdoor spaces.
- Planting and Pruning: Selection, planting, and maintenance of a wide variety of plants, shrubs, and trees.
- Soil Preparation and Fertilization: Ensuring optimal soil conditions through testing, conditioning, and fertilizing.
- Hardscaping: Installation of patios, walkways, retaining walls, and other structural elements.
- Water Features: Design and installation of ponds, fountains, and irrigation systems.
- Pest Control: Environmentally friendly pest management solutions to protect your plants.
All services are provided by qualified professionals who adhere to industry standards, ensuring the highest quality of work and customer satisfaction.
3. Client Responsibilities
To facilitate the successful delivery of our services, the Client agrees to the following responsibilities:
- Property Access: Provide access to the property during agreed-upon times and dates.
- Safety Measures: Ensure that the garden area is safe and free from hazards that could impede our work or pose risks to our team.
- Clear Communication: Communicate any specific requirements, preferences, or concerns clearly and promptly.
- Preparation: Prepare the garden area as needed, such as removing personal items or obstructions that may interfere with our work.
- Payment: Adhere to the agreed payment schedule as outlined in the Payment Terms section.
- Feedback: Provide timely feedback on our services to help us improve and ensure your satisfaction.
Failure to comply with these responsibilities may result in delays or additional charges. We are committed to working collaboratively with our clients to ensure a smooth and successful gardening experience.
4. Payment Terms
Our payment terms are designed to be fair and transparent. The details are as follows:
- Deposits: A deposit may be required prior to the commencement of services, typically ranging from 20% to 50% of the total estimated cost, depending on the scope of the project.
- Invoices: Invoices will be issued upon completion of services or as per the agreed schedule. Clients will receive detailed invoices outlining the services provided and associated costs.
- Payment Methods: We accept various payment methods, including cash, bank transfers, and major credit cards. Electronic payments are processed securely to protect your financial information.
- Late Payments: Payments not received by the due date may incur late fees, typically calculated as a percentage of the outstanding amount. Continued late payments may result in the suspension of services until the account is settled.
- Additional Costs: Any additional services requested by the Client that were not included in the original agreement will be billed separately. Clients will be notified of any extra costs before they are incurred.
We strive to make our payment process as straightforward as possible and are open to discussing payment plans for large projects to accommodate our clients' financial situations.
5. Cancellation and Refund Policy
We understand that circumstances may change, and you may need to cancel or reschedule our services. Our policies are as follows:
- Cancellation Notice: Clients may cancel or reschedule services with at least 48 hours notice before the scheduled service date.
- Cancellation Fees: Cancellations made within 48 hours of the scheduled service may be subject to a cancellation fee, typically equivalent to 10-20% of the total service cost.
- Refunds: Refunds for services not rendered will be processed within 14 business days of the cancellation request. Refunds will be issued using the same payment method as the original transaction, unless otherwise agreed upon.
- Rescheduling: Clients may reschedule services without penalty by providing the required notice. We will make reasonable efforts to accommodate new dates based on availability.
In the event of unforeseen circumstances, such as extreme weather conditions or emergencies, Gardeners West Ham reserves the right to reschedule services without penalty. Clients will be notified promptly in such cases.
6. Limitation of Liability
At Gardeners West Ham, we are committed to providing high-quality services. However, our liability is limited under the following conditions:
- Indirect Damages: We are not liable for indirect or consequential damages arising from our services, including but not limited to loss of use, profits, or data.
- Force Majeure: We are not responsible for damages caused by factors beyond our control, such as natural disasters, extreme weather, or other unforeseen events.
- Pre-existing Conditions: We are not liable for any damages resulting from pre-existing conditions in the garden area that were not previously disclosed or identified.
- Client Property: While we take utmost care to protect client property, we are not liable for any accidental damages unless caused by our negligence or willful misconduct.
Our total liability under any circumstances is limited to the total value of the services provided to the Client. This limitation applies regardless of the form of action, whether in contract, tort, or otherwise.
7. Intellectual Property
All designs, plans, materials, and intellectual property created by Gardeners West Ham remain the exclusive property of the company. Clients are granted a non-exclusive, non-transferable license to use these materials for personal use only. Any reproduction, distribution, or modification of our intellectual property without prior written consent is strictly prohibited.
This includes, but is not limited to, landscape designs, plant selection guides, and any proprietary techniques or methodologies developed by our team.
8. Privacy Policy
We respect your privacy and are committed to protecting your personal data. Our privacy practices include:
- Data Collection: We collect personal information necessary to provide our services, such as contact details, payment information, and property specifics.
- Data Usage: Collected data is used solely for the purpose of delivering our services, managing client accounts, and communicating with clients.

9. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the United Kingdom. Any disputes arising from this agreement shall be subject to the exclusive jurisdiction of the courts located in West Ham.

10. Changes to Terms

11. Confidentiality
Both parties agree to maintain the confidentiality of any sensitive information disclosed during the course of the agreement. This includes, but is not limited to, proprietary business information, personal data, and any other confidential materials.
Confidentiality obligations remain in effect even after the termination of services, ensuring that all private information is protected from unauthorized disclosure.
12. Termination
Either party may terminate the agreement under the following conditions:
- Material Breach: If either party fails to comply with the terms outlined in this agreement, the non-breaching party may terminate the agreement after providing written notice and a reasonable opportunity to cure the breach.
- Mutual Agreement: Both parties may mutually agree to terminate the agreement at any time.
- Insufficient Performance: If the Client is unsatisfied with the quality of services provided despite reasonable efforts to address concerns, they may terminate the agreement.
Upon termination, the Client is responsible for payment of all services rendered up to the termination date. Any deposits or prepayments may be subject to refund policies outlined in the Cancellation and Refund Policy section.
13. Indemnification
The Client agrees to indemnify, defend, and hold harmless Gardeners West Ham, its employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, and expenses arising out of or in any way connected with the Client's use of our services, including any misuse of facilities or violation of these Terms and Conditions.
This indemnification obligation survives the termination of the agreement and remains in effect indefinitely.
14. Insurance
Gardeners West Ham maintains appropriate insurance coverage to protect against potential liabilities arising from our services. This includes general liability insurance and workers' compensation insurance for our employees.
Clients are encouraged to verify their own insurance coverage to ensure comprehensive protection of their property and personal assets.
15. Subcontracting
We reserve the right to subcontract or delegate tasks to third-party service providers to fulfill the Services. All subcontractors are required to adhere to the same standards and Terms and Conditions as Gardeners West Ham.
Gardeners West Ham remains fully responsible for the performance and conduct of any subcontractors involved in the provision of services.
16. Notices
Any notices or communications required or permitted under these Terms and Conditions must be in writing and delivered personally, sent by certified mail, or sent via email to the addresses provided by the parties.
Notices are considered effective upon receipt by the intended recipient, unless otherwise specified.
17. Entire Agreement
These Terms and Conditions constitute the entire agreement between the Client and Gardeners West Ham regarding the use of our services. They supersede all prior or contemporaneous communications, whether electronic, oral, or written, between the Client and Gardeners West Ham.
Any amendments or modifications to this agreement must be made in writing and signed by both parties to be considered valid.
18. Severability
If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. Such provisions shall be modified to reflect the original intent, to the extent possible, without changing the fundamental terms of the agreement.
19. Waiver
Failure by Gardeners West Ham to enforce any right or provision of these Terms and Conditions shall not be deemed a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of Gardeners West Ham.
20. Headings
Headings used in these Terms and Conditions are for convenience and reference purposes only. They do not affect the interpretation or construction of the provisions outlined herein.
21. Force Majeure
Gardeners West Ham shall not be liable for any failure to perform its obligations under these Terms and Conditions if such failure results from circumstances beyond its reasonable control, including but not limited to acts of God, war, terrorism, strikes, labor disputes, government orders, or any other unforeseeable event.
In the event of a force majeure occurrence, Gardeners West Ham will make reasonable efforts to notify the Client and resume services as soon as possible.
22. Compliance with Laws
Both parties agree to comply with all applicable local, state, and federal laws and regulations in the performance of their obligations under these Terms and Conditions.
This includes, but is not limited to, labor laws, environmental regulations, and safety standards relevant to gardening and landscaping activities.
23. Dispute Resolution
In the event of any disputes arising out of or relating to these Terms and Conditions or the Services provided, both parties agree to attempt to resolve the dispute through good faith negotiations.
If a resolution cannot be reached through negotiation, the parties agree to engage in mediation before pursuing any other legal remedies.
All disputes subject to mediation shall be conducted in West Ham, and any decisions or agreements reached through mediation shall be binding on both parties.
24. No Third-Party Beneficiaries
These Terms and Conditions are intended solely for the benefit of the Client and Gardeners West Ham. No other individual or entity shall have any rights, benefits, or claims under these Terms unless expressly stated otherwise.
25. Assignment
The Client may not assign or transfer their rights or obligations under these Terms and Conditions without the prior written consent of Gardeners West Ham. Any attempted assignment without consent shall be null and void.
Gardeners West Ham reserves the right to assign or transfer its rights and obligations under these Terms and Conditions to any successor or affiliate without the Client's consent.
26. Independent Contractors
Gardeners West Ham and the Client acknowledge that they are independent contractors and that nothing in these Terms and Conditions shall be construed to create a partnership, joint venture, employer-employee, or agency relationship between them.
Neither party has the authority to bind the other or to incur any obligations on behalf of the other without prior written consent.
27. Language
These Terms and Conditions are written in English. In the event of any discrepancies or errors in translation, the English version shall prevail.
28. Acknowledgment
By engaging our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please refrain from using our services.
